These Terms & Conditions constitute the sole contractual framework governing the relationship between SAWA and any person purchasing a retreat or experience via this website. By completing a booking, the participant confirms they have read, understood, and accepted these Terms & Conditions in full, without reservation.
ARTICLE 1 — OFFER & INFORMATION
The information presented on this website regarding retreats, pricing, payment conditions, and cancellation terms constitutes a preliminary offer within the meaning of Article L.211-8 of the French Code du Tourisme.
Retreat descriptions and images are provided in good faith and for information purposes only. SAWA cannot be held liable for minor inaccuracies. Retreats are offered subject to availability.
Participants are advised to assess their own physical ability to participate in the proposed activities and to consult a healthcare professional if in any doubt. SAWA cannot be held liable for incidents arising from a participant's failure to do so.
ARTICLE 2 — PRICES
All prices are quoted in euros, inclusive of applicable taxes, unless otherwise stated. Prices do not include transport to and from the retreat location, travel insurance, personal expenses, or any other items not explicitly listed in the retreat description.
SAWA reserves the right to modify prices at any time. The price applicable is that confirmed at the time of booking. In accordance with Article L.211-12 of the Code du Tourisme, the confirmed price may be revised upward or downward to reflect variations in transport costs, applicable taxes, or exchange rates. No price revision may be applied within 30 days of the retreat start date.
Participants based outside the European Union are solely responsible for any applicable local taxes or customs duties.
ARTICLE 3 — BOOKING & PAYMENT
To confirm a retreat spot, participants must pay a non-refundable deposit of €500. The remaining balance is due in installments as communicated at the time of booking, with full payment required no later than 30 days before the retreat start date. SAWA reserves the right to release a spot if payment deadlines are not met.
Payment is processed securely via Stripe, in compliance with PCI-DSS standards. SAWA does not store card details. A booking confirmation and invoice will be sent by email upon receipt of the deposit.
SAWA reserves the right to refuse a booking from any participant who has an outstanding balance from a previous booking or with whom a payment dispute is ongoing.
ARTICLE 4 — NO RIGHT OF WITHDRAWAL
In accordance with Article L.221-28 of the French Code de la consommation, the right of withdrawal does not apply to tourism and leisure services provided on a specific date or period. All bookings made via this website are therefore final. Cancellations are governed exclusively by Article 5 below.
ARTICLE 5 — CANCELLATION & MODIFICATION
5.1 Cancellation by the participant
Any cancellation must be notified to SAWA in writing by email. Any deposit paid to secure a retreat booking is non-refundable. In the event of cancellation by the participant, no refund will be issued regardless of the reason, including but not limited to flight cancellations or delays, travel disruptions, illness, or personal circumstances. Any retreat interrupted or partially attended for any reason will not give rise to a refund.
SAWA shall not be held responsible for any additional costs incurred by the participant, including flights, accommodation, or other travel-related expenses.
5.2 Spot transfer
If unable to attend, a participant may transfer their spot to another person meeting the same conditions, subject to SAWA's prior written approval. The request must be submitted no later than 7 days before the retreat start date. The original participant and the transferee are jointly responsible for any outstanding balance. An administrative fee may apply.
5.3 Cancellation by SAWA
In the event that SAWA cancels a retreat — due to insufficient participants, safety reasons, or force majeure as defined under Article 1218 of the French Civil Code — participants will be fully reimbursed for all sums paid to SAWA, with no further compensation due. SAWA's liability is strictly limited to the amounts paid for the retreat itself. SAWA cannot be held responsible for any costs incurred by participants in connection with their travel arrangements.
5.4 Modification by SAWA
SAWA reserves the right to modify non-essential elements of a retreat (such as accommodation provider, activity schedule, or collaborating instructors) where required by circumstances beyond its control. Destination, dates, and price are considered essential elements. In the event of a modification to an essential element prior to departure, participants may either accept the modification or cancel without penalty and receive a full refund.
ARTICLE 6 — TRANSPORT
Unless expressly stated in the retreat description, transport to and from the retreat location is not included. Participants are solely responsible for arranging their own travel. SAWA shall not be held liable for delays, cancellations, or incidents occurring during transport, nor for any resulting impact on the retreat.
ARTICLE 7 — TRAVEL INSURANCE
All participants are required to hold valid travel insurance covering medical expenses, injury, cancellation, and travel disruption prior to the retreat start date. Participation is conditional upon this requirement being met. SAWA does not provide or arrange insurance on behalf of participants.
ARTICLE 8 — HEALTH & PERSONAL RESPONSIBILITY
Participants confirm that they are in good physical and mental health and fit to take part in the activities offered. Any health conditions, injuries, or personal circumstances that may affect participation must be disclosed to SAWA prior to arrival. Failure to disclose relevant information may result in exclusion from certain activities without entitlement to a refund.
Participants acknowledge that retreat activities involve inherent physical risk and agree to follow all safety instructions provided by SAWA and its collaborating guides and instructors. Participation is undertaken at the participant's own risk.
ARTICLE 9 — PHOTOGRAPHY & IMAGE RIGHTS
During SAWA retreats, photos and videos may be taken for use on the SAWA website, Instagram, and other SAWA communications. Participants will be asked for explicit written consent before the retreat begins. Participation is not conditional upon consenting to photography. Consent may be withdrawn at any time by written request to SAWA.
ARTICLE 10 — LIABILITY
In accordance with Articles L.211-16 and following of the French Code du Tourisme, SAWA assumes full responsibility for the proper execution of the services contracted, whether performed directly or through third-party providers. SAWA may be exonerated from liability where damage is attributable to the participant, to an unforeseeable third party, or to force majeure.
Neither SAWA nor any collaborating guides, instructors, or partners shall be held liable for injuries, accidents, or damages sustained during the retreat; loss, theft, or damage of personal belongings; or additional costs resulting from cancellation or disruption of travel arrangements made by the participant.
ARTICLE 11 — FORCE MAJEURE
Neither party shall be held liable for failure to perform their obligations where such failure results from a force majeure event as defined by Article 1218 of the French Civil Code — including but not limited to natural disasters, epidemics, war, transport blockages, or telecommunications outages. In such cases, if the retreat cannot be held, SAWA will reimburse all sums it holds that have not been disbursed on behalf of the participant.
ARTICLE 12 — PERSONAL DATA (GDPR)
SAWA processes personal data in accordance with EU Regulation 2016/679 (GDPR) and French data protection law. Participants may exercise their rights (access, rectification, deletion, objection, portability) by contacting SAWA at the email address above. For further detail, please refer to our Privacy Policy.
ARTICLE 13 — INTELLECTUAL PROPERTY
All content on this website — including texts, images, designs, logos, and other materials — is the exclusive property of SAWA or used under licence. Any reproduction, distribution, or use without prior written authorisation is prohibited.
ARTICLE 14 — COMPLAINTS
Any complaint relating to the execution of a retreat must be submitted to SAWA in writing at the email address above as soon as possible. If no satisfactory response is received within 60 days, the participant may refer the matter free of charge to the Tourism and Travel Mediator:

ARTICLE 15 — SEVERABILITY
If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue to apply in full.
ARTICLE 16 — APPLICABLE LAW & JURISDICTION
These Terms & Conditions are governed by French law. Any dispute not resolved through mediation shall be submitted to the competent courts of Nice, France.
